You
will not be able to obtain registration for trade marks which are
devoid of any distinctive character. Trade marks which
consist exclusively of signs or indications which may serve, in
trade, to designate the kind, quality, quantity, intended purpose,
value or geographical origin of the goods or services traded under
the mark will not be registered. Signs exclusively indicating the
time of production of goods or of rendering of services or other
characteristics of goods or services will not be registered. Nor
will trade marks which consist exclusively of signs or indications
which have become customary in the current language or in the bona
fide and established practices of the trade.
However, if a trade mark has acquired
distinctiveness through use, it will not be refused registration
for the reasons in the paragraph above.
Trade marks consisting exclusively of the shape
resulting from the nature of the goods, a shape required to obtain a
technical result or a shape which gives substantial value to the
goods are also excluded from protection.
Trade marks contrary to public policy or to accepted
principles of morality, applications made in bad faith or trade
marks of such a nature as to deceive the public for instance as
to the nature, quality or geographical origin of the goods or
service are not registrable.
